WEBSITE OWNER, THE OFFERING, AND BINDING OF TERMS

  1. This website is owned and operated by Graham Lewis and Nathan Ward, private individuals.

  2. This document gives the terms and conditions under which you may use our website.

  3. This website offers visitors the opportunity to read, download and comment on our report into Safeguarding in the Church of England.

  4. By accessing or using this website, you approve that you have read, understood, and agree to be bound by these Terms.

 

WHO CAN USE THE WEBSITE?

  1. Anyone may read the content of our website, download the documents (see COPYRIGHT INFORMATION below) and engage with the PUBLIC Forum(s).

  2. Only persons over the age of 18 can access and engage with the MEMBERS Forum.

  3. The website is aimed at members, officers and employees of the Church of England and those interested in Safeguarding of children and vulnerable adults in the UK.
    Anyone else may access the site but should be aware that the content may not be relevant to their situation.

 

WHAT ARE THE REQUIREMENTS FOR SITE MEMBERSHIP?

  1. In order to become a Member of our website and to access the groups called Forums, you must be at least 18 years of age and possess the legal authority, right and freedom to enter into these Terms as a binding agreement.  

  2. You are not allowed to use this website and/or engage in the Forums if doing so is prohibited in your country or under any law or regulation applicable to you.

 

OUR RIGHT TO CHANGE THE WEBSITE AND ITS OFFERING

  1. We may, without prior notice, change the website; stop providing the services or any features of the services we offer; or create limits for the services.

  2.  We may permanently or temporarily terminate or suspend access to the website or to features of the website without notice and liability for any reason, or for no reason.

 

OUR RESPONSIBILITY

  1. We will endeavour to maintain the site in accordance with relevant UK laws and regulations.  We are not legal experts and are undertaking this work as volunteers with no payment or reimbursement of our expenses. 

  2. We will endeavour to remove within a reasonable time (noting that we are two volunteers for whom this is nowhere near a full-time occupation) content, whether provided by ourselves or posted by users, that is illegal, defamatory, offensive, a breach of intellectual property rights, or otherwise considered unacceptable that is notified to us by a User or other person or organisation, and which we agree should not be on the site.

  3. We will notify you immediately we become aware if any unauthorised access is gained to your personal information on either our IT equipment or the Wix servers.  

 

YOUR RESPONSIBILITY

  1. By using the site, you agree to use it solely for the purpose for which it was created – to encourage constructive discussion of Safeguarding processes, policies and procedures within the Church of England. 

  2. If you join and/or post in one of the Forums, you agree to abide by the guidance given and agree that the site owners may at any time delete any post they consider does not meet these guidelines or that may encourage others to breach the guidelines.

  3. If you join and/or post in one of the Forums, you agree that all other users of the Forum will be able to see any personal profile information that you have not chosen to hide, and to read, copy, share or reply to any of your posts or comments.

  4. If you join and/or post in one of the Forums, you agree that you will adhere to the copyright terms given below. 

  5. You accept that the site owners may cancel your membership of the Site and/or any Group at any time and without giving a reason. 

  6. You accept that the site owners are volunteers with limited time availability who may not be able to respond to a message either in a timely fashion or in the depth that may be wanted.

  7. Indemnification: You agree to indemnify and hold the site owner and report authors, Graham Lewis and Nathan Ward, harmless from any demands, loss, liability, claims or expenses (including legal fees), made against them by any third party due to, or arising out of, or in connection with your use of the website.
    (= If you, for example, post something defamatory, it’s you who gets sued not us.)

 

OWNERSHIP OF INTELLECTUAL PROPERTY AND COPYRIGHTS

  1. The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Graham Lewis and Nathan Ward.
    Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
    (= We own the copyright to the materials we offer on the site.  That’s it.  But see 3. below.)

  2. You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.
    (=PLEASE do not upload to the forums anything that you do not have the right to upload.)

  3. We have learnt from many other organisations’ and individuals’ publications, reports, comments, etc., in our preparation of our own report and offer it equally freely to others seeking to create or improve their own Safeguarding systems. 
    However, anyone using our report or a substantial part of our report for commercial or financial gain agrees to seek our permission first; in such cases we may ask the user to make a suitable donation to a charity of our choice.

  4. You may freely share the URL of this website.

 

RIGHT TO SUSPEND OR CANCEL USER ACCOUNT

  1. We may permanently or temporarily terminate or suspend your access to the Membership area of the site without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations.

  2. You may discontinue use of the site and/or cancel your Membership at any time.

 

LIMITATION OF LIABILITY

  1. To the maximum extent permitted by applicable law, in no event shall Graham Lewis or Nathan Ward be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

  2. To the maximum extent permitted by applicable law, Graham Lewis and Nathan Ward assume no liability or responsibility for any
    (i) errors, mistakes, or inaccuracies of content;
    (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and
    (iii) any unauthorized access to or use of Wix’s secure servers or the IT equipment of Graham Lewis and Nathan Ward, and/or any and all personal information stored therein.

 

RIGHT TO CHANGE AND MODIFY TERMS

  1. We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically though we will put a temporary note on the Home page if we make a substantial change to these Terms.

  2. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms.  If you do not agree to any of these terms or any future version of the Terms, you agree to not use or access (or continue to access) the website or the materials provided on it.

 

PREFERENCE OF LAW AND DISPUTE RESOLUTION

  1. These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of England and Wales, without respect to its conflict of laws principles.

  2. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by, a court of competent jurisdiction located in Medway County Court.
